1. Introduction

This Privacy Policy explains how InIt Coaching LLC, a Florida limited liability company ("CreativeBuddy," "we," "us," or "our"), collects, uses, shares, and protects your personal information when you use CreativeBuddy.ai (the "Service"). CreativeBuddy.ai is a United States-based, AI-powered content intelligence platform for mortgage professionals and real estate agents. The Service surfaces trending and viral public video content from TikTok, Instagram, and YouTube, generates content scripts and ideas tailored to your audience profile, and provides coaching on short-form video strategy. By creating an account or using the Service, you consent to the practices described in this Policy.

2. Information We Collect

2.1 Information You Provide

  • Account information: your name, email address, and password.
  • Profile Data: your business name, industry, company description, target audience, competitive advantages, key products, tone preferences, content topics, and social media handles.
  • Payment and billing information: processed and stored by our payment processor (we do not store credit card numbers).
  • Prompts and inputs: the requests, instructions, and other content you submit to generate scripts and ideas.

2.2 Information from Content Data Providers

The Service surfaces publicly available content metadata - such as video statistics, captions, creator handles, and view counts - from TikTok, Instagram, and YouTube via third-party data aggregators. CreativeBuddy does not connect to, access, or post from your personal social media accounts. We do not collect your social account credentials.

2.3 Automatically Collected Information

  • Device and browser information (type, version, operating system).
  • IP address and approximate location.
  • Usage data (features used, pages viewed, actions taken).
  • Log data (timestamps, error reports, diagnostic information).

2.4 Cookies

We use essential cookies (required to operate the Service and keep you signed in), analytics cookies (to understand how the Service is used), and functional cookies (to remember your preferences). You can control cookies through your browser settings, though disabling essential cookies may impair the Service.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service;
  • Surface relevant trending and viral content;
  • Generate AI-powered scripts and content ideas;
  • Provide coaching on short-form video strategy;
  • Improve and personalize the Service;
  • Analyze usage to debug and enhance features;
  • Communicate with you about updates, security, and account matters;
  • Detect and prevent fraud, abuse, and unauthorized access;
  • Comply with applicable law and legal obligations.

3.1 How We Do NOT Use Your Information

  • We do not make eligibility determinations about you.
  • We do not surveil you.
  • We do not discriminate against you.
  • We do not build advertising profiles and we do not sell your data.
  • We do not re-identify anonymized data.
  • We do not use your identifiable data to train third-party AI models. Third-party AI providers that process your prompts do so under their own terms, with model training disabled where that option is available.

4. Data Sharing and Disclosure

We share information only in the following circumstances:

  • Service Providers: cloud hosting, database, and analytics providers that support the operation of the Service.
  • AI Service Providers: providers that process your prompts and inputs to generate content. They do not train on your data and may retain inputs and outputs briefly for safety and abuse-prevention purposes.
  • Content Data Providers: third-party aggregators that supply publicly available content metadata.
  • Payment Processor: Stripe, Inc., which processes and stores your payment information.
  • Legal Requirements: when required by law, subpoena, court order, or to protect our rights, safety, or property.
  • Business Transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

We do not sell, rent, or license your personal information, and we do not share your data for cross-context behavioral advertising.

5. Data Retention

  • Account data is retained while your account is active and as required by law.
  • Prompts and Generated Content are retained according to your account settings.
  • AI processing logs are retained briefly by AI providers for safety and abuse-prevention purposes.
  • Upon account deletion or termination, your data is permanently deleted within 30 days, except for data we are required to retain for legal, tax, or fraud-prevention purposes, which may be retained for up to 7 years in accordance with applicable law.

6. Data Security

We protect your information using encryption in transit (TLS) and at rest, secure authentication, regular security assessments, access controls and audit logging, and an incident response process. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

6.1 Data Breach Notification

In the event of a data breach affecting your personal information, we will notify affected users within 72 hours of becoming aware of the incident, as required by applicable law.

7. Consent and Your Choices

7.1 Consent

By using the Service, you consent to the collection and use of your information as described in this Policy.

7.4 Deletion

You may request deletion of your data. Note that AI providers may retain inputs and outputs briefly for safety purposes, and we may retain certain data where required by law.

7.5 Withdraw Consent

You may withdraw your consent to our processing of your personal information at any time by contacting us at tfritz@tylreid.com or by deleting your account. Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal.

8. Your Privacy Rights

8.1 California Residents (CCPA)

If you are a California resident, you have the right to know what personal information we collect, to request deletion of your personal information, to opt out of the sale of your personal information (we do not sell personal information), and to non-discrimination for exercising your rights. 8.2 EEA and UK Residents (GDPR)

If you are located in the European Economic Area or the United Kingdom, you have the right to access, rectify, and erase your personal data, to restrict or object to processing, to data portability, and to lodge a complaint with your local supervisory authority.

8.3 Other State Privacy Rights

Residents of Virginia, Colorado, Connecticut, and other states with comprehensive privacy laws may have additional rights, including the right to access, correct, delete, and obtain a copy of their personal data, and to opt out of certain processing. 9. International Data Transfers

CreativeBuddy is based in the United States, and your data is stored and processed in the United States. Our AI providers may process data on servers located in the United States or internationally. For transfers of personal data from the EEA, UK, or Switzerland, we rely on Standard Contractual Clauses or your consent as the lawful basis for transfer.

10. Children's Privacy

The Service is intended for licensed professionals who are at least 18 years old and is not directed to anyone under 18. We do not knowingly collect personal information from minors. If we discover that we have collected information from a person under 18, we will delete it promptly.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will post any changes with an updated "Last updated" date, and we will communicate material changes via email or an in-app notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Policy.
